Citizenship and Naturalisation Solicitor

Becoming a British citizen is the final step in the immigration journey for many people who have made their home in the UK. Law and Justice Solicitors provide expert advice and representation on citizenship and naturalisation applications for clients in London, the West Midlands, and throughout the UK.

Eligibility Requirements

To apply for naturalisation as a British citizen you must generally meet the following requirements:

  • You are aged 18 or over.
  • You hold Indefinite Leave to Remain or have settled status.
  • You have lived in the UK for at least five years before the date of application (or three years if you are married to or in a civil partnership with a British citizen).
  • You have not been outside the UK for more than 450 days during the five-year period (or 270 days during the three-year period for spouses).
  • You have not been outside the UK for more than 90 days in the 12 months immediately before the date of application.
  • You are of good character.
  • You meet the English language requirement.
  • You have passed the Life in the UK test.

The Good Character Test

The good character requirement is assessed by the Home Office and considers a wide range of factors including criminal convictions, immigration history, financial conduct, and other matters. Having a criminal conviction does not automatically disqualify you, but the nature and severity of the offence and the sentence received will be considered. We strongly recommend seeking advice before applying if you have any convictions or if there are any other concerns about your good character.

Life in the UK Test and Language Requirement

You must pass the Life in the UK test and demonstrate knowledge of English, Welsh, or Scottish Gaelic to an acceptable standard. The language requirement can be met by holding a degree taught in English, passing an approved English language test, or through certain nationality exemptions. Some applicants are also exempt from the Life in the UK test depending on their age.

Application Process and Timeline

The naturalisation application is submitted online through the UK Visas and Immigration portal. Supporting documents must be submitted by post. The Home Office currently aims to decide applications within six months, though processing times can be longer. Once approved, you will be invited to attend a citizenship ceremony where you will take the oath or affirmation of allegiance.

Frequently Asked Questions

How long after ILR can I apply for British citizenship?

In most cases you must hold ILR for at least twelve months before you can apply for naturalisation. If you are married to or in a civil partnership with a British citizen, you can apply immediately after receiving ILR provided you meet the other requirements.

Can I have dual citizenship?

The UK permits dual citizenship in most cases. However, your other country of nationality may not permit it. You should check the nationality laws of your home country before applying for British citizenship if dual citizenship is a concern.

What happens to my travel during a citizenship application?

You can continue to travel during a citizenship application, but you should be mindful of the absence requirements. If you are planning a long trip abroad, seek advice before travelling to ensure it will not affect your application.
